Employer Participation Agreement

This Agreement is entered into between JobQuestPH (“Organizer”) and the participating company (“Employer”) that registers for recruitment services, job fairs, or hiring events organized through www.jobquest.ph. By participating in any JobQuestPH recruitment activity, the Employer agrees to the following terms.
1Purpose
JobQuestPH provides recruitment facilitation services including Physical Job Fairs, Virtual Job Fairs, Resume database access, AI-assisted candidate screening tools, and Recruitment marketing services. JobQuestPH acts solely as a facilitator between employers and job seekers.
2Employer Eligibility
Employers must ensure that the company is legally registered in the Philippines or in its country of origin, job opportunities offered are legitimate and lawful, and recruitment practices comply with Philippine labor laws and regulations. For overseas recruitment, employers must comply with DMW regulations where applicable.
3Job Posting Responsibilities
Employers agree that job postings accurately describe job roles and requirements, do not contain misleading or fraudulent information, do not promote illegal recruitment activities, and do not discriminate unlawfully against applicants. JobQuestPH reserves the right to remove or reject job postings that violate these standards.
4Participation in Job Fairs
Employers participating in JobQuestPH job fairs agree to conduct professional and ethical recruitment activities, provide truthful hiring information, and respect all applicants and participants. JobQuestPH reserves the right to deny participation to employers engaging in fraudulent, unethical, or abusive recruitment practices.
5AI Screening and Recruitment Tools
Employers acknowledge that JobQuestPH may provide AI-assisted screening tools that generate candidate suitability insights. AI results are advisory tools only, AI analysis should not be the sole basis for hiring decisions, and employers remain fully responsible for hiring outcomes.
6Fees and Payments
Participation fees for events or services shall follow the pricing agreed upon between JobQuestPH and the Employer. Unless otherwise stated, fees are non-refundable once the event or service has commenced. Promotional discounts or bundled offers are subject to availability.
7Data Privacy Compliance
Employers agree to handle applicant data in compliance with Republic Act No. 10173 (Data Privacy Act of 2012). Employers must use applicant data only for recruitment purposes, protect personal information from unauthorized disclosure, and avoid misuse of applicant data.
8Limitation of Liability
JobQuestPH shall not be liable for employer hiring decisions, salary disputes between employers and applicants, or employment outcomes. JobQuestPH provides recruitment services "as is" without employment guarantees.
9Non-Circumvention
Employers agree not to circumvent or bypass JobQuestPH services by directly engaging with candidates introduced through JobQuestPH job fairs, virtual hiring events, resume database, or AI screening tools for the purpose of avoiding recruitment service fees where applicable.
10Governing Law
This Agreement shall be governed by the laws of the Republic of the Philippines. By registering for a JobQuestPH event or service, the Employer confirms that they have read, understood, and agreed to this Employer Participation Agreement, Liability Waiver, and Non-Circumvention Policy.
